Trademark question regarding album covers and book covers?
I'm looking to start an online company that prints t-shirts with images from popular book and album covers. During my research, I came across several sources who told me that these specific images were not protected and that I didn't need to acquire permission to use them on my t-shirts. Can anyone help point me in the right direction or advise me on the issue? Thanks!
An example would be a t-shirt an image of the Berenstain Bears..
"Several sources"?, several unreliable sources I would say.
Here you have copyright issues besides trademarks. Almost all album & book covers are copyrighted by the authors or publishing company.
Only material on the public domain is fare game (like a 1900 cover of Hamlet for example or a classical painting from Leonardo).
Visit the site of the US Copyright Office and read the whole law.
Avoid being sued and having to pay heavy fines (like over $50,000 per T-shirt and probably some jail time).
As for the "Berenstain Bears", they belong now to the "Berenstain Enterprises, Inc" so you really need their consent or you might be taken to court.
